JASWANT SINGH, J (ORAL) The petitioner, after serving three years in District Hoshiarpur, as per the option in terms of the transfer policy, was posted as Science Teacher at Government High School, Bani Lodhi, vide order dated 30.06.2016 (Annexure P-3). The petitioner, after some resistance, was permitted to join at his new place of posting on 10.07.2016.

By referring to the orders at Annexures P-4, P-6 and P-7, it is contended that the respondents are hell-bent on transferring the petitioner outside the said School by showing it to be a vacant post.

Upon notice, reply by way of short affidavit dated 29.9.2016 of Rajesh Kumar, District Education Officer (SE), Pathankot has been filed in court. In para 4 of the reply, it is stated that the impugned order dated 06.8.2016 (P.7) qua the transfer of the petitioner from GHS Banilodhi (Pathankot) to GHS, Bahtath Sahib (Pathankot) has since been withdrawn vide order dated

CWP No.16410 of 2016 #2# 10.8.2016.

Learned counsel for the petitioner has not disputed the cancellation of his transfer order as also with regard to his being continued at his place of posting i.e GHS, Bani Lodhi. Dismissed as infructuous.
