(Oral) By way of present writ petition, petitioner is seeking quashing of appointment of respondent Nos. 2 to 6 on the ground that their names were included in the merit list, despite the fact that their names were figured below the name of the petitioner in the merit list as per the marks.

On asking of the Court, Mr. Vikas Chatrath, Advocate accepts notice on behalf of respondent No. 7. Learned counsel for the petitioner is directed to supply copy of the petition to the learned State counsel by today itself during the course of the day. The case of the petitioner was declined on the ground that she was overage, as on 01.01.2014, she has completed 27 years. C.W.P No. 17381 of 2015 -2Learned counsel for respondent No. 7 submits that this issue came up for consideration before this Court in a case of Amit Sharma vs. Union of India and anr, decided on 07.12.2015 in CWP No. 12365 of 2015 whereby this Court dismissed the petition being not maintainable and liberty was granted to the petitioner to approach Central Administrative Tribunal.

Faced with the above situation, learned counsel for the petitioner wishes to withdraw the present petition. Dismissed as withdrawn with a liberty to the petitioner to approach Central Administrative Tribunal for vindication of her grievances.
