Challenge in the present petition is to order 21.05.2013 (Annexure P-3) passed by Ombudsman Electricity, Punjab (respondent no. 1). Petitioner-Corporation has challenge the order inter alia on the ground that same authority has passed orders Annexures P-11 & P-12 (in connected petition i.e. CWP No. 23683 of 2012) in favour of the Corporation despite the factual and legal aspects being entirely similar. According to Corporation, there being inconsistency in the orders passed by the said authority, matter needs to be remitted to same authority for decision afresh. This prayer is not opposed by learned counsel appearing for the respondents. In view of above, present petition is allowed. Impugned order passed by Ombudsman Electricity, Punjab is set-aside.
