VIKAS BAHL, J. (ORAL) Prayer in the present petition is for grant of anticipatory bail in case FIR No.61 dated 02.07.2022 registered under Sections 365, 341, 342, 506, 34 of the Indian Penal Code, 1860 and Sections 25 & 27 of Arms Act, 1959 at Police Station Kotli Surat Mallian, District Batala. On 29.07.2022, this Court was pleased to pass the following order:- "Learned counsel for the petitioner inter alia contends that the petitioner is working as the clerk of an Advocate and he had advised Sagar Masih that in case, the complainant did not agree to his marriage with Sophia, then he would get protection for them from the Court and on account of the same, the petitioner has been implicated in the case of alleged kidnapping of the complainant and even as per his own version, the complainant was relieved on the same day, without having any injury caused to him. It is further submitted that there is delay of two days in registration of FIR and the petitioner is not involved in any other case. Notice of motion for 13.09.2022.

In the meantime, in the event of arrest, the petitioner shall be released on interim bail subject to his furnishing personal bonds and surety to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and ISHWAR SINGH GARHWAL 2022.09.16 11:42 I attest to the accuracy and authenticity of this document

Learned counsel for the petitioner has submitted that in pursuance of the said order, the petitioner has joined the investigation. Learned State counsel, on instructions from ASI Gurmukh Singh, has submitted that the petitioner has joined investigation and is not required for further investigation.

Keeping in view the above said facts and circumstances moreso, the facts which have been noticed in the order dated 29.07.2022, and also the fact that the petitioner has joined the investigation and is not required for further investigation, the present petition is allowed and the interim order dated 29.07.2022 is made absolute. Nothing stated above shall be construed as an expression of opinion on the merits of the case and the trial would proceed independently of the observations made in the present case which are only for the purpose of adjudicating the present bail petition.
