Petitioner seeks grant of regular bail under Section 439 Cr.P.C in case bearing FIR No.388 dated 16.09.2019 registered under Sections 147, 149, 323, 307, 341, 506 IPC at Police Station Azad Nagar, Hisar, District Hisar. CRM-M No.14735 of 2021 filed for grant of regular bail was got dismissed as withdrawn on 16.07.2021. When the Court was at the verge of deciding the said petition on merits, learned counsel for the petitioner made a prayer for withdrawal of the same.

CRM-M No. 36916 of 2021 -2This Court had noticed some incriminating facts in the order vis-a-vis conduct of the petitioner before the Court of Sessions in mis-leading the Court. It was only on account of the application filed by the complainant under Section 439(2) Cr.P.C., bail was cancelled by the Court of Sessions on 25.02.2021 by observing that the petitioner through his mother had mis-lead the Court by mentioning first bail in the title of the petition whereas it was the third bail application. The second bail application was dismissed on merits. In the event of mentioning third bail application, the same would have listed before the same Presiding Officer and result would have been different, but the petitioner intentionally mentioned first bail application and got the same listed before some different Presiding Officer, who had granted bail to him despite rejection of the same on earlier two occasions by different Presiding Officer.

Learned counsel for the petitioner again prays for withdrawal of the petition.

Dismissed as withdrawn.
