(ORAL) After arguing for some time, learned counsel for the petitioner submits that he would be contended and satisfied that in case this Court issue direction to the trial Court to consider the exemption application of the petitioner in the light of M/s Bhaskar Industries Ltd. Versus M/s Bhiwani Denim and Apparels Ltd. and others (2001) AIR (SCW) 3413, given the fact that the petitioner is very senior journalist based in Chandigarh. The prayer is innocuous, as such, the petition is disposed of. This Court requests the trial Court to be extreme flexible while considering the exemption application and in case the exemption application is not allowed then the concerned trial Court shall pass a detailed, speaking and reasoned order. It is clarified that unless it is extremely necessary in the trial, the concerned Court should not insist upon the presence of the petitioner before the Court and his counsel would substitute in light of M/s Bhaskar Industries Ltd. (supra).
