Jaswant Singh,J(Oral) Claim of the petitioner for compassionate appointment as Constable based on the oustee's rights of his father-Darshan Singh (landowner) for construction of Peona Thermal Power Plant at Village Gobindpura, Tehsil Budhlada,Distt.Mansa in terms of policy dated 8.11.2011(P-1) has been declined vide impugned order dated 16.7.2014(P17). It is case of the petitioner that impugned orders are based on incorrect fact that only 17 marlas of land belonging to the father of the petitioner had been acquired whereas it is asserted that factually acquisition was of more than 04 kanals of agriculture land.
To substantiate the same, reference was made to Annexure P-7, which is reply filed on behalf of the Revenue Authorities in another case wherein it has been so admitted. Learned State counsel on previous date of hearing had prayed for time for re-consideration of the claim of the petitioner. At the time of hearing today,learned State counsel has placed Rajinder Parshad Joshi 2016.12.
CWP 16527/2016 on record a copy of another order dated 7.12.2016 whereby upon reconsideration also the claim of the petitioner has been rejected by assigning reasons.
At this stage,learned counsel for the petitioner prays for permission to withdraw the petition to enable his client, if so advised, to file a fresh petition challenging the order dated 7.12.2016.
