ARUN MONGA, J. (ORAL) Petitioner herein, inter alia, seeks issuance of a writ in the nature of certiorari for quashing the impugned order dated 02.09.2020 (Annexure P-8) vide which petitioner has been transferred from Civil Hospital, Assandh (Karnal) to Civil Hospital, Ambala Cantt, on administrative grounds with immediate effect. 2.

Learned counsel for the petitioner contends that petitioner was given additional charge of nursing sister at Civil Hospital, Assand. Her husband is also serving as Clerk in BEO Office, Assandh. Now the petitioner has been transferred to Civil Hospital, Ambala which is at the distance of more than 120 kms on an alleged complaint moved by one Kapil and Satish Kumar.

While issuing notice of motion, this Court ordered that petitioner shall not be relieved from Civil Hospital, Assandh, vide order dated 08.10.2020.

Learned State counsel submits that let the petitioner file a fresh representation before the competent authority giving her mitigating circumstances and also taking plea that being a couple case the petitioner should be transferred to a place where her husband is or can be posted. 5.

Learned counsel for the petitioner submits that the petitioner would file representation within 15 days.

In view of the above, the instant writ petition is disposed of with a direction to the competent authority that in case any such representation is filed by the petitioner, the same be decided in accordance with law and as per the applicable transfer policy. 7.

Representation, if is filed within 2 weeks from today, interim order dated 08.10.2020 passed by this Court shall continue to operate until representation is disposed of.
