(ORAL) Prayer in the first petition under Section 482 Cr.P.C. is for quashing the impugned order dated 08.04.2022 passed by the Additional Sessions Judge, Fast Track Court, Sonipat (Annexure P-4), whereby the Trial Court directed the investigating agency to conduct further investigation under the provisions of Section 173 (8) Cr.P.C., upon the application(s) (Annexure P-3) moved by the petitioner for determining the age of the prosecutrix under the provisions of Section 94 of the Juvenile Justice (Care and Protections of Children Act, 2015 read with Rule 54 (18) (iv) of The Juvenile Justice (Care and Protection of Children) Model Rules, 2016 in case bearing No. SC No.21 of 2022 tiled 'State v. Pardeep etc.', FIR No.

337 dated 12/08/2021 under Sections 4 of POCSO Act and 120B, 365, 376(2)(g), 506 IPC and 3(2)(v) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (Amendment 2015), later on Section 6 of POCSO Act, Section 212, DIVYANSHI 2024.09.

CRM-M-34625-2022 (O&M) -2 - 34 and 376-D IPC was added, registered at Police Station Sadar, Sonipat. (Annexure P-1).

Learned counsel for the State, on instructions from ASI Narinder Singh, as well as learned counsel for the complainant inform this Court that the present petition has been rendered infructuous as the petitioner has been convicted by the learned Additional Sessions Judge, Fast Track Court, Sonepat, vide judgment dated 23.01.2024. Learned counsel for the petitioner does not dispute the above said fact.
