(ORAL) In the present writ petition, the prayer which has been made by the petitioner is for the grant of pension after giving him 3rd ACP, which become due from the date 04.03.2014. Further, a prayer has been made by the petitioner for the grant of interest on the said payment. Counsel for the respondents states that as per the short reply of Sh. Dinesh Shastri, DEO, Gurugram, on behalf of respondents No.1 to 5, filed on 04.07.2018, after examining the case of the petitioner, the relief claimed by the petitioner has been granted, vide order dated 10.08.2017 (Annexure R-1) wherein he has been granted 3rd ACP w.e.f. 04.03.2014.
Counsel for the petitioner states that the benefits accruing out of the order dated 10.08.2017 have already been paid to him, but the NARESH KUMAR 2019.01.15 17:15 I attest to the accuracy and integrity of this document Chandigarh
CWP-16572-2016 (O&M) -2petitioner is entitled for the interest also on the said payments including the arrears of pension which have been paid after a considerable delay. Counsel for the petitioner states that a liberty be given to the petitioner to file a representation to claim the interest on the delayed payments including the payments made in furtherance of the order dated 10.08.2017 (Annexure R-1).
The prayer of the petitioner is accepted.
Let the petitioner make a representation to the respondents giving the details of payments made to him and the delay occurred in making of these payments.
In case, any such representation is filed by the present petitioner within a period of one month from today, the respondents shall pass an appropriate order in accordance with law in respect of the interest claimed by the petitioner in the said representation.
