(Oral) Petitioner is seeking direction to promote him as teshildar with effect from the date his juniors were promoted i.e. 15.09.2011. Upon notice, short reply by way of affidavit dated 03.07.2015 has been filed by the Joint Secretary to Government of Haryana, Revenue and Disaster Management Department, in which, it has been stated that the petitioner has been given deemed date of promotion w.e.f. 07.05.2012 instead of 15.09.2011 because junior to him Sh. Roshan Lal was promoted to the post of Tehsildar, vide order dated 07.05.2012. As per ACP Rules, 2008, the case of the petitioner has been considered and he has been allowed higher scale under ACP Rules, 2008 w.e.f. 01.10.2010, vide order NARESH KUMAR 2016.06.03 16:41 I attest to the accuracy and integrity of this document Chandigarh dated 06.05.2015 (Annexure R-II).

CWP No.18255 of 2014 (O&M) -2As per affidavit dated 16.03.2016 filed on behalf of respondent No.1 by Joint Secretary to Government of Haryana, Revenue and Disaster Management Department, the petitioner was shown senior to respondent Nos.2 and 3 (Rajesh Kumar and Naresh Kumar) inadvertently. The tentative seniority list (Annexure R-III) has been issued and against which the objections have been invited from the affected persons. Keeping in view that the petitioner has been promoted w.e.f. 07.05.2012 and he has been granted the ACP Scales, no further directions are required to be issued in the present writ petition. However, the petitioner is granted liberty to file his objections to the tentative seniority list (Annexure R-III) and make a representation for grant of interest on the delayed payment of ACP scales.

With the aforesaid observations, the present writ petition stands disposed of.
