Peoner herein is defendant No.1 before learned Civil Judge (Junior Division) Ludhiana in Civil Suit bearing CS/9663/2021 tled as Ranwant Kaur Vs. The Ludhiana Improvement Trust and Others. Peoner is aggrieved by the order dated 28.02.2023 (Annexure P-1), whereby its defence was struck off.

As per the impugned order, defendant No.1 i.e. peoner had put in appearance for the first me on 27.01.2022 through its Advocate and despite adjourning the ma2er for several dates, but failed to file wri2en statement and it was in these circumstances that defence was struck off on 28.02.2023. The impugned order, thus, would reveal that the peoner had availed many opportunies, but failed to file the wri2en statement. 3.
Not only above, it is very important to noce that though the impugned order was passed by the trial Court, striking off the defence of the peoner way back in February, 2023, but the said order has been assailed by the peoner before this court in May, 2025 i.e. a6er the period of more than 02 years. The said delay & latches on the part of peoner in itself is sufficient to reject the peon.

Learned counsel for the peoner could not convince this Court about any illegality or perversity in the impugned order nor she could explain the huge delay in moving this peon so as to assail the order. No merit. Dismissed.
