This petition has been filed under Section 439(2) Cr.P.C. for cancellation of anticipatory bail granted to the respondents No.4 and 5 by the learned Additional Sessions Judge, Amritsar vide order dated 20.04.2019 in case FIR No.59 dated 29.04.2016 under Sections 308, 325, 323, 148, 149 IPC registered at Police Station Majitha, District Amritsar. Learned counsel for the petitioner does not dispute the fact that the offence under Section 308 IPC was deleted during investigation. However, later on it was again added by the police. It is further submitted that since the case has been committed to the Sessions Court, therefore, the bail granted by trial Court for the added offences deserves to be cancelled.
