Mz.Sudeepti Sharma,DAG Punjab Jaswant Singh,J(Oral) Petitioner-Ajit Kumar is stated to be possessing a three year Diploma in Mechanical Engineering and was appointed as a Dumper Operator in the Irrigation Department at Ranjit Sagar Dam on regular basis on 13.3.1996. His services having been declared surplus, he was adjusted on the post of Driver in the Forest Department vide order dated 13.5.2014 (P-1) and posted with DFO Gurdaspur. It so transpires that owing to his previous experience in the conduct of Election work in the office of ADC Pathankot during his services in the Irrigation Department he was retained in the office of ADC Pathankot. He claims to have worked throughout in the office of ADC Pathankot although his allocation was with the Forest Department vide Annexure P-1.

His salary continued to be disbursed by the Forest Department till February 2016. Since his salary w.e.f. March 2016 was not disbursed he was constrained to file the present writ petition. The predicament of the petitioner is that he is not being relieved by the office of ADC Pathankot and his salary is not being released by his parent-Forest Department.

CWP 16606/2016 Upon notice, learned State counsel on instruction from Mr.Charanjit Singh,DFO Gurdaspur and Mr.Suresh Kumar Soni, Superintendent office of DFO Gurdaspur submits that salary of the petitioner due w.e.f. March 2016 till 30th September 2016 has since been sanctioned and released. She further states that the matter will be pursued with the office of ADC Pathankot regarding his relieving or otherwise and salary will be released in consultation with the office of ADC Pathankot. In view of the aforesaid stand of the State, present petition is disposed of as infructuous. However, it is clarified that in case any grievance still persists the petitioner will be free to seek recalling of this order.

Disposed of in the above terms.
