In the instant petition, petitioner seeks grant of subsidy in terms of Industrial Policy, 1992. Learned counsel for the petitioner submits that order dated 28.11.2011 was passed by respondent no. 2 wherein his claim was rejected inter alia on the ground that judgment passed by this court in CWP No. 19007 of 2001 titled as M/s Balak Gases Oxygen Gas plant & anr. vs. State of Punjab & ors was pending before the Hon'ble Supreme court. He submits that matter has now been decided.

Faced with this situation, learned State counsel, on instructions from Harjinder Singh, Superintendent, Department of Industries and Commerce, Punjab, who is present in court submits that a fresh order shall be passed by the competent authority after considering all the documents submitted by the petitioner in light of order dated 04.10.2016. Order be passed as expeditiously as possible.

In view of above, no further direction is necessary. Petition is disposed of.
