(Oral) Learned counsel for the petitioner states that unfortunately a factual incorrect plea was taken by the petitioner before the authorities below and based upon that plea only, the question raised by this Court on 24th August, 2015 arose for consideration. He says that given an opportunity, the petitioner will file a fresh petition on the same cause of action and with better particulars. With liberty aforementioned, the writ petition stands dismissed as withdrawn.
