*** VIKRAM AGGARWAL, J. (ORAL) On 18.05.2026, the following order was passed:- "This is a petition instituted under Article 227 of the Constitution of India, praying for the issuance of a direction to the Court of Additional District Judge, Chandigarh (Executing Court) where the execution application No.1707 of 2017 (Annexure P-1) titled as M/s Intech Capital Ltd. Vs. M/s Samgul Graphics & Printer and others, is pending to decide the same in a time-bound manner.
Learned counsel for the petitioner submits that during the pendency of the execution petition, which is pending since 2017, bank accounts were closed by the Judgment-debtors after attachment and a 1 Kanal property in Sector-8, Chandigarh has also been alienated on account of the delay tactics adopted by the judgment-debtors. He submits that the Court has been a silent spectator to all of the above. He further submits that another application with regard to attachment of an industrial property at Chandigarh, is pending adjudication before the executing Court for the last three years.
-2Before proceeding further, let a report from the District and Sessions Judge, Chandigarh be called giving reasons as to the delay in disposal of the execution petition which is pending since 2017 and as regards the assertions made by learned counsel for the petitioner.
The needful be done within a period of one week from today.

In compliance with the same, a report has been received from the District & Sessions Judge, Chandigarh, which reads as under:- "It is submitted that report in the matter was called from the concerned Court ie. the Court of Ms. Harinder Sidhu, Learned Additional District Judge, Chandigarh, wherein the concerned Judicial Officer has submitted that she has assumed charge of the post of Additional District & Sessions Judge at Chandigarh on 29.04.2026, on transfer from Patiala, Punjab. The present case is now pending for 29.05.2026 and hence the same has not been put up before her till date. The concerned Judicial Officer has summarized the proceedings of the present case in the format of history sheet.
Perusal of the report so submitted by the concerned Judicial Officer reveals that numerous applications were filed by the decree holder as well as the Judgment debtor in the present case and disposal of these applications took considerable time. Apart from this, proceedings of the case were also affected due to the outbreak of Covid-19 in the year 2020 and 2021. It has also been brought on record that there was a chance of compromise between the parties and, as such, the case was adjourned for the said purpose, but the matter could not be settled.
It is submitted that vide order dated 27.09.2022 passed in CR-4131-2022 by the Hon'ble High Court, the executing Court was directed to adjourn the proceedings in
-3the execution beyond the date fixed in the Hon'ble High Court. The said revision was decided by the Hon'ble High Court on 13.03.2023 and copy of the said order was put up before the Court on the next date of hearing i.e. 15.04.2023. So far as an application for attachment of industrial property at Chandigarh is concerned, it is submitted that the said application was filed under Order 21 Rule 54 read with Section 151 CPC on 29.11.2023. Thereafter, record was summoned from the Arbitrator but on receipt of the same, it was returned as it was not properly indexed and page marked. The Arbitrator appeared in person on 17.09.2024 and submitted the record. On 14.10.2025, it was brought to the notice of the Court that reply to the application under Order 21 Rule 54 CPC filed on 29.11.2023 has not been filed by the judgment debtors and on request the case was adjourned for filing reply to the said application. Reply to the said application has been filed on 30.01.2026. The case is now pending for addressing arguments on 29.05.2026.
It is further submitted that the concerned Judicial Officer has been asked to expeditiously dispose of the instant case in view of the directions of Hon'ble the Supreme Court as well as the Hon'ble High Court. Copy of the report submitted by the concerned Judicial Officer is enclosed herewith for your kind perusal."

In view of the same, no further orders are required to be passed. Further, since directions have already been issued by the Hon'ble Apex Court as regards disposal of execution petitions within a period of six months, no further directions are required to be passed by this Court, at this stage, fixing any time frame.

The present revision petition is accordingly disposed of, keeping in view the report of the District and Sessions Judge, Chandigarh.
-4However, in case no tangible progress is made, the petitioner shall be at liberty to file an application for revival of the present petition or to file a fresh petition in accordance with law.
