(ORAL) Learned counsel for the petitioner submits that he does not intend to press the present writ petition for a writ in the nature of Certiorari for quashing of the suspension order dated 22.6.2016 (Annexure P-1) for the time being, as his statutory appeal against the said suspension order is pending decision before the appellate authority. He submits that feeling aggrieved against the suspension order, petitioner has already filed his statutory appeal vide Annexure P-3 and also made a prayer for staying the suspension order till the decision of the appeal. However, appellate authority has neither decided the pending stay application nor the appeal, which is causing prejudice to the petitioner. Notice of motion.

On the asking of the court, Sh. Yatinder Sharma, Addl. A.G., Punjab, accepts notice on behalf of the State and Sh. C.L. Premy, Advocate, accepts notice on behalf of the caveator.

CWP No.16667 of 2016 petition is disposed of, with a direction to the appellate authority i.e. Secretary, Rural Development and Panchayats, Punjab, Vikas Bhawan, Sector 62, SAS Nagar, Mohali-respondent no.1 to decide the statutory appeal of the petitioner at an early date, preferably within a period of three months from the date of receipt of certified copy of this order. However, it is made clear that till the appeal of the petitioner is decided, the suspension order, shall remain stayed.

With the above said observations made and directions issued, present writ petition stands disposed of.
