By virtue of instant petition preferred under Articles 226/227 of the Constitution of India, petitioner has sought issuance of a writ in the nature of mandamus directing the respondents to release retiral benefits such as gratuity, provident fund, leave encashment and full pensionary benefits as admissible to him along with all consequential benefits as well as interest on delayed payments.

At the very outset of the arguments, learned counsel for the petitioner submits that though legal notice dated 20.02.2018 (P-1) was duly served upon the respondents but till date neither any response has been received nor any decision has been taken by the respondents thereon. He further submits that he feels satisfied in case a direction is issued to respondent No.1 to consider and decide the afore-said legal notice within a stipulated period. Accordingly, instant petition is disposed of with a direction to respondent No.1-Managing Director, Punjab State Power Corporation, Patiala or any other competent officer(s) subordinate to him, to consider the case of the petitioner as unfolded in legal notice (P-1) and to decide the same in accordance with law, within a period of three months from the date of receipt of certified copy of this order.

However, if petitioner still feels aggrieved by any order of the aforesaid authority, he shall be at liberty to have recourse to the remedies available under law as well as to approach this Court.
