-.- JAISHREE THAKUR J. (ORAL) This is a petition that has been filed for grant of regular to the petitioner in FIR No.420 dated 04.11.2019 registered under Sections 147, 148, 149, 302, 323, 325 IPC at Police Station Sadar Fatehabad, District Fatehabad.

Learned counsel for the petitioner would argue that a reading of the FIR would not show that the petitioner has been attributed any injury upon the deceased or the complainant. In fact, it would reflect that there was a general scuffle that took place, which resulted in injuries to Mangal Singh, who subsequently died. It is further argued that the investigation is complete and the challan stands presented and therefore, custodial interrogation of the petitioner would not be required. Learned counsel appearing on behalf of the respondent-State opposes grant of regular bail to the petitioner by contending that the allegations levelled against the petitioner are serious in nature. In view of the fact that the investigation is complete and the challan stands presented and further parents of the petitioners have already been allowed regular bail by the trial Court coupled with the fact that the trial is likely to take some time to conclude, the instant petition is allowed and the petitioner is directed to be released on regular bail on execution of personal/surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
