Ms.Madhvi Pundir, Advocate for Mr. Vikas Chatrath, Advocate for respondent no.7. **** G.S.SANDHAWALIA, J, (Oral) Counsel for the petitioner submits that the petitioner does not come under the zone of consideration for admission in the spot round of counselling. It is submitted that the petitioner has deposited a sum of 40,000/- which was debited from the bank account. It is pointed out that as per Clause 4.12.3 of the Information Brochure (Annexure P/1) if the seat is not allotted in the spot round of counselling, spot round participation fee of 40,000/- is liable to be fully refunded. Paragraph 6 of the written statement of respondents no.
1 to 6 is also to the same effect which reads as under:- "That in routine, the fee of unsuccessful candidates is returned back to them in accordance with the procedure formulated and depicted in the Prospectus of admission and as such the amount deposited by the petitioner shall also be returned in due course." Accordingly, counsel for the petitioner submits that the present writ petition may be dismissed as not pressed, however, the respondentUniversity be directed to refund the said amount. Accordingly, the present writ petition is dismissed as not pressed. The respondent-University will, however, refund the amount of 40,000/- deposited as spot round participation fee by the petitioner within a period of three weeks from the date of receipt of a certified copy of this order.
