The present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 seeking quashing of order dated 29.05.2015 (Annexure P-5) passed by learned Sub Divisional Judicial Magistrate, Jagraon, District Ludhiana in FIR No.128 dated 06.07.2011 registered under Sections 382, 332, 353, 186, 148, 149 of IPC, 1860 and Sections 25, 54, 59 of Arms Act, 1959 registered at Police Station Sadar Jagraon whereby the petitioner has been declared as proclaimed offender. 2.

Learned counsel for the petitioner contends that provisions as laid down under Section 82 of Cr.P.C. have not been complied with. Learned counsel for the petitioner, on instructions further submits that the petitioner undertakes to appear before the trial Court concerned on each and every date and shall not seek any exemption for his personal appearance on any date of hearing before the trial Court. I have heard learned counsel for the petitioner and perused the material placed on record.

No legitimate ground to interfere in the impugned order dated 29.05.2015 (Annexure P-5) is made out and the present petition is hereby, dismissed.

However, in case the petitioner surrenders before the trial Court within 07 days from today at 10.00 a.m. and moves an application for grant of regular bail, on his doing so, the trial Court shall consider and decide the same on the very same day.
