HARINDER SINGH SIDHU, J Prayer is for grant of anticipatory bail in criminal case No.129 dated 10.09.2015 filed under Section 138 of the Negotiable Instruments Act, which is pending before the learned SDJM, Ganaur. Respondent No.1 had filed the said criminal complaint against the petitioner for dishonoring of a cheque amounting to Rs.5 lacs. It is stated that the petitioner was released on bail. However, the petitioner did not cause his appearance before the learned trial Court on 14.02.2019. Subsequently also, he absented himself from the Court on various dates because of which he was declared as proclaimed person vide order dated 21.08.2019 and registration of FIR under Section 174-A was ordered against him.

Learned counsel for the petitioner states that his nonappearance was not intentional. In fact, the petitioner was suffering from depression. He has since compromised the matter with the complainant. He undertakes to appear before the learned trial Court on any date to be fixed by this Court.

Having heard learned counsel for the parties and taking into account the facts of the present case, this petition is disposed of with the observation that the petitioner may appear before the learned trial Court on or before 12.10.2021. On his doing so, he shall be enlarged on bail by the trial Court subject to his furnishing bail bonds and surety bonds to its satisfaction. He shall also file an undertaking before the concerned Court to continue appearing as and when required apart from following all the terms and conditions fixed in this respect.
