**** KIRTI SINGH , J. (Oral) This fifth petition under Section 483 of BNSS has been filed for grant of interim bail to the petitioner for a period of three months, for treatment and look after his father who is suffering from serious disease for the last more than one year, in case FIR No.161 dated 16.12.2022, under Sections 376(2)(n) and 506 IPC (Section 6 of POCSO Act added later on), registered at Police Station Sadar Ahmedgarh, District Sangrur. 2.

Learned counsel for the petitioner submits that the father of the petitioner is suffering from a large ulcerative lesion in the right lumbar region, and also cellulitis and myositis. It is further submitted that the doctor treating the petitioner's father ordered the conduct of culture and sensitivity test of aerobic bacteria pus on 24.04.2025, report of which revealed the presence of pseudomonas aeruginosa. It is contended that the petitioner is the only male member in the family available to take care of his ailing father and his mother is not in a position to accompany or assist his father in traveling daily to the hospital, which is located at a considerable distance from their residence.

In compliance with the order dated 28.05.2025, learned State counsel, on instructions from ASI Narang Singh, has verified the medical condition of the petitioner's father and confirms that he is indeed in a serious condition and is required to undergo surgery. However, learned State counsel, while opposing the grant of bail, relies upon the order dated 12.05.2025 passed by the learned trial Court, highlighting that serious allegations have been levelled against the petitioner. 4.

In view of the contentions made by learned counsel for the petitioner and considering the medical condition of the father of petitioner which has been verified by the learned State counsel, this Court is of the view that the petitioner is entitled to concession of interim bail at this stage. 5.

Accordingly, petition stands allowed and petitioner is granted interim bail for a period of 01 month from 31.05.2025, on his furnishing bail bonds/surety bonds to the satisfaction of the learned Trial Court/Duty Magistrate concerned, on such terms and conditions as may be imposed by the Trial Court.

Needless to say that after the expiry of said period, the petitioner shall surrender before the concerned Jail immediately. Pending application(s), if any, also stands disposed of accordingly.
