Through instant petition filed under Section 528 of the BNSS, 2023, petitioner - Sukhwinder Kaur, aged about 51 years, has sought appropriate directions to the respondent-Police Authorities for registration of an FIR and for conducting a fair, impartial and effective investigation on the basis of complaint bearing No.461-PC/4-26 dated 11.02.2026 (Annexure P-1).

Learned counsel for the petitioner contends that after payment of an amount of approximately Rs.7.00/8.00 lakhs, petitioner was unable to continue paying further installments, whereupon bank officials took possession of the house.

It is further contended that certain articles lying in the house were found missing thereafter and, despite submission of complaint dated 11.02.2026 (Annexure P-1) against the bank officials, no action has been taken till date.

Prima facie, this Court is not satisfied with the nature of allegations levelled in the application/complaint dated 11.02.2026 (Annexure P-1), as certain disputed questions of fact are involved. Moreover, neither said complaint nor the instant petition discloses as to what amount of loan was sanctioned/disbursed to the petitioner. Otherwise also, disputes of such nature are not amenable to the provisions of Section 528 of the BNSS, 2023, particularly when an appropriate alternative remedy is otherwise available to the petitioner in accordance with law.

Accordingly, instant petition stands dismissed, being devoid of merits.
