This order shall dispose of the above mentioned two petitions wherein petitioners Vikram Singh @ Romi, Parminder Singh @ Deepa and Varinder Singh, are seeking grant of regular bail in a case registered vide FIR No.79, dated 6.7.2020, Police Station Daba, District Ludhiana, under Section 379-B, 34 IPC. 2.

The FIR was lodged at the instance of Manjit Singh, wherein it is alleged that he is owner of 'Bachan Gas Agency' and that on 6.7.2020, he had asked his Cashier Pawandeep Singh to deposit amount in the bank and that while Pawandeep Singh was on his way to deposit the amount, 3 young men stopped Pawandeep Singh's scooter and while brandshing a 'daat' snatched the bag containing an amount of `11.67 lakhs from Pawandeep Singh and fled away from the spot while also taking the keys of Pawandeep Singh's scooter. 3.

Learned counsel for the petitioners has submitted that none of the petitioners is named in the FIR and that they have been nominated subsequently on the basis of the disclosure statement either made by themselves or by a co-accused. It has been informed that the accused Vikram (petitioner) along with one Baldev Singh and Parminder Singh were arrested on 10.7.2020 in connection with another FIR i.e. FIR No.174, dated 10.7.2020, under Section 21 of NDPS Act, Police Station Division No.6, Ludhiana, wherein they admitted having participated in the present incident and also nominated Varinder Singh and Parvinder Singh @ Prince as his co-accused. Learned counsel has further submitted that co-accused Parvinder Singh has

CRM-M-32020-2020 (O&M) & CRM-M-1722-2021 (O&M) - 3 - already been granted bail and as such the petitioners deserve the concession of bail on the ground of parity.

Opposing the petition, the learned State counsel has submitted that since an amount of `3.15 lakhs was recovered from Vikram and another `20,000/- was recovered from Varinder Singh, the allegations against them virtually stands substantiated. Learned State counsel has however, not disputed that the petitioners have been nominated as an accused on the basis of their disclosure statements or their own confessions. It has also been informed that as on date the petitioners have been behind bars since the last about 5 months. 5.

I have considered rival submissions addressed before this Court. 6.

Having regard to the nature of allegation and the fact that investigation is concluded and challan stands presented, no useful purpose would be served by further detaining the petitioners behind bars. Both the petitions, as such, are accepted and the petitioners are ordered to be released on bail subject to their furnishing bail bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
