Petitioner has posed a challenge to order dated 18.04.2016 passed by the Tribunal at Moga. A preliminary objection has been raised by learned counsel appearing for respondent no. 2 that appeal would be maintainable at the instance of petitioner in view of judgment reported as Paramjit Kumar Saroya vs. The Union of India and anr., 2016 (3) RCR (Civil) 146.

This court finds substance in the plea. In view of same, petition is disposed of and petitioner is relegated to the remedy of filling an appeal before the appellate authority. In case same is filed within two week's from today, it shall be decided by the authority at the earliest, in any case not later than six week's. Needless to observe that execution pursuant to order passed by the Tribunal shall be kept in abeyance till the appeal is entertained by the appellate authority.
