**** RITU BAHRI, J. (Oral) Petitioner is seeking directions to the respondents to release all the retiral benefits including leave encashment after his superannuation on 30.06.2010.

Upon notice, the written statement has been filed on behalf of respondent No.2. It has been stated in the written statement that the petitioner was charge-sheeted on 03.01.2012 for causing the loss and the matter was entrusted to the inquiry officer for regular departmental enquiry. After holding enquiry, the petitioner was held responsible for the charges leveled against him. Thereafter, a notice was issued against the petitioner under Rule 19.2 (g) of HAFED Common Cadre Rules, 1988, vide letter NARESH KUMAR 2016.03.05 10:23 I attest to the accuracy and integrity of this document Chandigarh

CWP No. 18477 of 2014 -2dated 19.01.2014 and in pursuant to notice he has deposited an amount of `1,06,457 under protest and subject to the final decision of above mentioned charge-sheet, which is still to be finalized. A charge-sheet dated 12.02.2015 is also stated to be pending for final decision, vide which, the petitioner was held responsible for `5,21,998/-. After retirement, the amount of 300 days earned leave has been released to the petitioner, vide order dated 02.02.2015 and other retiral benefits will be paid to him after finalization of disciplinary proceedings.

In view of above facts, the present writ petition is disposed of with the directions to the respondents as well as to the petitioner to conclude the proceedings in the charge-sheets in question, within a period of six months, from the date of receipt of certified copy of this order.
