Prosecutrix/appellant moved the instant appeal, against the judgment of acquittal dated 25.3.2019 passed by Additional Sessions Judge (Exclusive Court for Heinous Crimes Against Women)Patiala whereby accused Harinder Singh, Pawandeep Singh and Mewa Singhrespondents (2 to 4 herein) have been acquitted of the charges under Sections 120-B, 420, 342, 376, 313, 506 IPC in case FIR No. 394 dated 27.12.2016, PS Tripuri, which has yet not come up for motion hearing before any Bench due to restricted Court functioning in view of Covid19 and is now fixed for 12.01.2022. Today CRM-31864 of 2021 has been listed wherein prayer has been made by the applicant/appellant seeking withdrawal of the appeal. The application is supported by an affidavit dated 23.09.2021 of the applicant/appellant wherein it stated that applicant does not want to pursue the appeal and hence she may be permitted to withdraw the appeal.

CRM-A 1698/2019(O&M) applicant reiterates the prayer made in the application. At the oral request made by the learned counsel for the applicant/appellant, the main appeal is preponed and taken up for hearing itself.
In view of the above, CRM-31864/2021 is allowed and CRM-A 1698/2019 is dismissed as withdrawn.
Since the main appeal itself stands dismissed as withdrawn, the application seeking grant of Leave to Appeal as well as condonation of 42 days' delay in filing the appeal also stand dismissed accordingly.
