(ORAL) Prayer in this writ petition filed under Articles 226/227 of the Constitution of India is for quashing the office order dated 05.11.2014 (Annexure P-16) whereby earnest money of the petitioner has been forfeited and penalty at the rate of ` 500/- per day has been levied upon the petitioner.

After arguing for some time, learned counsel for the petitioner in view of the facts averred in the written statement prays that as certain facts are required to be proved by leading evidence, he may be allowed to withdraw the present writ petition with liberty to approach the Civil Court. 3.
