By virtue of instant petition preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ in the nature of mandamus directing the respondents to release the emoluments or additional increment for the period he has performed duties on higher post and revise his pension and other retiral benefits on the basis of last pay drawn by him at the time of his retirement while performing duties on higher post i.e. Head Master in officiating capacity and to pay arrears along with interest @ 12% per annum. 2.

At the very outset of the arguments, learned counsel for the petitioner submits that though legal notice dated 01.03.2018 (P-4) was duly served upon the respondents but till date neither any response has been received nor any decision has been taken by the respondents thereon. Accordingly, instant petition is disposed of with a direction to respondent No.2-Director of Public Instructions (SE), Mohali, to consider the case of the petitioner as unfolded in legal notice (P-4) and to decide the same in accordance with law, within a period of three months from the date of receipt of certified copy of this order. However, if petitioner still feels aggrieved by any order of the aforesaid authority, he shall be at liberty to have recourse to the remedies available under law as well as to approach this Court.
