By this order, Criminal Misc. No. M-31703 of 2020 and Criminal Misc. No. M-31938 of 2020 shall stand disposed of. Suraj Parkash and Bharat Bhushan have filed two separate petitions praying for grant of regular bail pending trial in a criminal case arising from FIR No. 146 dated 09.08.2020, registered under Section 307, 324, 323, 148 & 149 IPC, at Police Station Shahpur Kandi, District DEEPAK KUMAR BHARDWAJ 2020.10.17 13:17 I attest to the accuracy and integrity of this document

As per the case of the prosecution, Ankit and Shubham were coming on Royal Enfield motorcycle when the petitioners along with other co-accused attacked them. From the reading of the FIR, it is apparent that Suraj Parkash is alleged to have hit left knee of the first informant. The aforesaid injury on the left knee has been declared simple, whereas the allegations against Bharat Bhushan is that he, with the reverse side of Dattar, gave blow on the left thumb of the first informant. The petitioners are in custody since 12.08.2020. Smt. Kiran Devi, related to the petitioners, had registered an FIR against the family of the injured on 13.01.2019. The petitioners allege that they have been falsely implicated.
Keeping in view the custody of the petitioners and the contention of learned counsel for the petitioners, it is considered appropriate to direct their release on bail. Hence, both the petitions are accepted and the petitioners, namely Suraj Parkash and Bharat Bhushan are ordered to be released on regular bail subject to their furnishing bail/surety bonds to the satisfaction of the learned Area Judicial Magistrate/Chief Judicial Magistrate/Duty Magistrate.
