In this writ petition filed under Article 226 of the Constitution of India, the petitioner has prayed for issuance of a writ of in the nature of mandamus directing the respondents to allot/assign the work invited vide tenders dated 15.2.2018, 16.2.2018 and 20.2.2018 in compliance with notification dated 2.10.2014 (Annexure P-2).

The petitioner is a registered Society vide registration certificate dated 16.8.2017 (Annexure P-1). Government of Punjab vide notification dated 2.10.2014 (Annexure P-2) in continuance of earlier notification dated 11.7.2011 granted opportunities to the registered societies in the State of Punjab for allotment of public work. It was specifically made clear that all the skilled and unskilled works upto ` 40 lakhs would be allotted to the registered societies in the State of Punjab. CWP-11595-2018 -2thereto, respondents No.3 to 5 invited quotations for various works. The petitioner also submitted its quotation. The petitioner wrote a letter to respondent No.2 for the allotment of work to the petitioner being the lowest quotation rates, but to no effect. Thereafter, vide letter dated 27.3.2018 (Annexure P-3), the petitioner requested respondent No.2 to look into the matter and to do the needful, but no response has been received till date. Hence, the present writ petition.

After perusing the present petition and without expressing any opinion on the merits of the case, we dispose of the present petition by granting liberty to the petitioner to file a detailed and comprehensive representation raising all the pleas as raised in the present writ petition before the appropriate authority. It is directed that in the event of a representation being filed by the petitioner within a period of one week from the date of receipt of the certified copy of the order, the same shall be decided in accordance with law by passing a speaking order and after affording an opportunity of hearing to the petitioner within a period of two weeks from the date of receipt of the representation. The petitioner shall be entitled to lead any evidence to substantiate its claim before the concerned authority.
