We have heard the learned counsel representing the parties at length.

The Family Court has declined to waive off six months cooling off period for recording the statements of the parties at the time of second motion. The correctness of such order is challenged in this appeal. 3.
The statements of the parties were recorded at the time of first motion on 01.04.2025. Both the parties who are nearly 37-38 years old have been living separately from August 2022 and have no children from the marriage.

The learned counsel representing the parties have stated that the possibility of living together is remote. It has further been stated that the parties would like to proceed further and live their independent lives. First Appeal Order No. 3306 of 2025 detailed settlement arrived at between the parties was filed while filing the petition under Section 13-B of the Hindu Marriage Act, 1955. Various other litigations pending between the parties have already been withdrawn. 5.
Keeping in view the aforesaid facts, this Court is of the considered view that the prayer of the parties merits acceptance. Hence, the present appeal is allowed and the impugned order passed by the Family Court is modified while directing the Court to record the statements of the parties at the time of second motion on 26.05.2025 at 11:00 A.M.
