Jaswant Singh,J(Oral) Petitioner stands promoted as Lecturer in Punjabi with effect from 17.5.2012. He belongs to Scheduled Caste category. His claim for promotion with effect from the date his junior namely Nirmal Singh, also belonging to Scheduled Caste category and promoted as Lecturer in Punjabi w.e.f. 15.7.1994, has been declined vide speaking order dated 11.3.2016 Learned counsel for the petitioner submits that in the speaking order, it has wrongly been assumed that Nirmal Singh was placed as senior to the petitioner whereas from the seniority list (P-4) it is evident that he is placed much below the petitioner.

After hearing the learned counsel for the petitioner, it is accepted that said Nirmal Singh as per P-4 is placed junior to the petitioner. However, it is evident that said Nirmal Singh had acquired the essential qualification of post graduate qualification in the year 1985 and on the day he was promoted as Lecturer, petitioner had not submitted any proof of he having passed the post graduate qualification. The degree released to him is dated 14.8.1996. Thus,there was no material on record of the department that would have shown that the petitioner possessed the essential Rajinder Parshad Joshi 2016.08.29 15:17 I attest to the accuracy and integrity of this document

CWP 16908/2016 qualification of post graduate for promotion as Lecturer on the day his junior-Nirmal Singh was promoted.

For the reasons stated above,finding no merit in this writ petition the same is hereby dismissed.
