(Oral) *** By this petition, filed under the provisions of Section 438 of the Cr.P.C, the petitioner seeks the concession of anticipatory bail, upon FIR no.266, dated 25.05.2022, having been registered at Police Station Zirakpur, District SAS Nagar, Mohali, alleging therein the commission of offences punishable under Sections 323, 341, 506, 148, 149 and 427 of the IPC, with Section 379-B thereof added subsequently in the FIR. Learned counsel for the petitioner vehemently argues that it being a question of parking dispute and only a simple injury having actually been inflicted on the complainant, the petitioner may be admitted to anticipatory bail.

Though otherwise learned counsel may have been correct in his contention, however looking at the fact that 3/4 persons are alleged to have damaged the vehicle on the road deliberately and thereafter the allegation against the petitioner being that after the complainant was pulled out of his DHARAM VIR 2022.08.02 14:05 I attest to the accuracy and integrity of this document

101) CRM-M-33203 of 2022 -2vehicle by those people, he had been hit by an iron rod by the petitioner, an allegation also being that Rs.50,000/- were stolen from the vehicle, I do not think it is an appropriate case for admitting the petitioner to anticipatory bail. Consequently, this petition is dismissed.

However, nothing stated herein above shall be taken to be an observation of this court on the merit of the case and naturally, the petitioner files a petition under the provisions of Section 439 of the Cr.P.C.
