The petitioner has approached this Court seeking a direction to the respondent for release of amount of compensation on account of acquisition of land owned by him.

The stand taken by the respondent is that there is some civil litigation pending pertaining to the right to receive compensation on account of acquisition of land. Whatever undisputed amount was there, the same has been released to the landowner. Only disputed amount is pending. Learned counsel for the petitioner submitted that some part of the compensation payable to the petitioner is not in dispute. If an opportunity is given, he can apprise the Collector about the same and if he is satisfied, at least that amount can be released. Disputed amount can be

Learned counsel for the State did not have any objection to the aforementioned prayer being granted.

After hearing learned counsel for the parties, we dispose of the present writ petition giving liberty to the petitioner to approach respondent giving entire material in support of his claim regarding no dispute being there pertaining to some portion of land, so that the compensation qua the same can be disbursed to him. If the Collector is satisfied, he will disburse undisputed amount of compensation of the share of the petitioner to him. Ordered accordingly.
