(ORAL) In the present writ petition, the petitioner is challenging the order dated 09.06.2015 (Annexure P-9), by which, a sum of `2,57,840/- was withheld by the respondents from his pensionary benefits. Learned counsel for the respondents states that the amount, which was withheld by the respondents, has already been ordered to be released to the petitioner and he has handed over a copy of order dated 20.02.2020 to learned counsel for the petitioner that the amount of `2,57,840/-, which was withheld temporarily, has already been ordered to be released to the petitioner.

Learned counsel for the petitioner prays that the respondents be time bound to release the actual benefits of `2,57,840/- and further the petitioner is also entitled for the grant of interest on the said amount as the same was withheld by the respondents arbitrarily. CWP-17913-2015 -2Learned counsel for the petitioner further states that even the other retiral benefits of the petitioner were also withheld by the respondents and were only released in the year 2019 though the petitioner retired on 31.08.2007.

Learned counsel for the respondents states that the actual benefits of `2,57,840/- will be released to the petitioner within a period of four weeks from today.

Learned counsel for the respondents further states that in case the petitioner moves any representation for the grant of interest on the delayed release of the pensionary benefits, the same will be examined in accordance with law especially keeping in view the law laid down by the Full Bench of this Court in A.S. Randhawa Vs. State of Punjab and others, 1997(3) SCT 468 and appropriate order will be passed and in case, after the passing of the order, the petitioner is found entitled for interest, the same will be released to him within a period of three months. Learned counsel for the petitioner states that keeping in view statement made by learned counsel for the respondents, the petitioner does not want to press the present writ petition any further at this stage and the same may be disposed of having not pressed. Ordered accordingly.
