***** ARCHANA PURI, J. (Oral) Perusal of the paperbook reveals that on 28.08.2025, despite service, none had made appearance on behalf of the respondent. Even on the subsequent dates, none had made appearance on his behalf. Today also, none has made appearance on his behalf. As such, the respondent is proceeded against ex parte.

Counsel for the applicant heard.

The applicant-wife has filed the present application for seeking transfer of the petition under Section 9 of the Hindu Marriage Act i.e. DMC/387/2025, titled 'Dicky Garg Vs. Muskan Garg', filed by the respondent-husband, pending in the Family Court, Bathinda and she seeks transfer of the same to the Court of competent jurisdiction at Ferozepur. It is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 02.02.2025. On account of the matrimonial dispute, the parties are residing separate. The applicant is Sonu 2025.09.24 08:51 I agree to specified portions of this document P&HHC

TA-717-2025 not having any source of earning and as such, she has filed the petition under Section 144 of the Bharatiya Nagarik Suraksha Sanhita, 2023 i.e. MNT-332025, which is pending in the Courts at Ferozepur and the respondent is making appearance in the same. The distance between the two places is stated to be 110 kilometres.

Considering the mitigating circumstances, as stated aforesaid and also considering the fact about the respondent having not come forward to resist the application, the transfer application is allowed and the petition under Section 9 of the Hindu Marriage Act i.e. DMC/387/2025, titled 'Dicky Garg Vs. Muskan Garg', filed by the respondent-husband, stands transferred from the Family Court, Bathinda, to the Court of competent jurisdiction at Ferozepur. The requisite record of the aforesaid case be sent by the Family Court, Bathinda, to the District and Sessions Judge, Ferozepur. Learned District and Sessions Judge, Ferozepur, shall assign the said petition to the Family Court, Ferozepur. Even, the parties are directed to appear before the Family Court, Ferozepur, within a period of one month from today onwards.
