**** Rakesh Kumar Jain, J. (Oral) The petitioner has challenged the appointment of respondent no.4 to the post of Lambardar of village Meghot Halla, Tehsil Nangal Chaudhary, District Mohindergarh.
It is submitted that the Collector had appointed the petitioner as Lambardar but his appointment has been set aside by the Divisional Commissioner vide his order dated 11.03.2016 and the Financial Commissioner vide his order dated 03.05.2017. The only case set up by the petitioner is that there is an FIR registered against respondent no.4 under Sections 279, 337 and 338 IPC but the said case is pending and has not been decided against respondent no.4. Therefore, it has been found by the higher authorities that respondent no.4 has not earned any disqualification and otherwise he has been found to be more meritorious than the petitioner and, thus, order of the Collector was set aside.
CWP No.13410 of 2017 [ 2 ] ***** In view thereof, I do not find any error in the impugned orders and hence, the present writ petition is hereby dismissed being denuded of any merit, though without any order as to costs.
