**** Rakesh Kumar Jain, J. (Oral) This petition is filed against the order dated 09.05.2011 of the Collector, Gurdaspur, order dated 11.03.2016 of the Commissioner (Appeals), Jalandhar Division, Jalandhar and the order dated 08.02.2017 of the Financial Commissioner (Appeals), Punjab, by which the order of appointment of respondent no.5 as Lambardar of village Dadwal, District Gurdaspur, now District Pathankot has been upheld.
In short, the Tehsildar-cum-Assistant Collector 2nd Grade recommended the name of respondent no.5 for appointment to the post of Lambardar. The Collector appointed respondent no.5 as Lambardar vide order dated 09.05.2011 holding that the village Dadwal is a Be-chirag village and, thus, the Lambardar is appointed from the adjacent village. The said order was unsuccessfully challenged before the Divisional Commissioner and the Financial Commissioner and now the petitioner has approached this Court by way of filing the present petition.
CWP No.13415 of 2017 [ 2 ] **** Counsel for the petitioner has failed to point out any defect in the impugned orders except for submitting that the Lambardar has to be from the same village, whereas respondent no.5 is a resident of the village which is about 7 Kms. away from village Dadwal but he cannot support this contention by any rule or law.
Consequently, the present petition is hereby dismissed with costs of `10,000/-, which shall be deposited by the petitioner with the Registry of this Court within a period of two months from today. July 03, 2017 (Rakesh Kumar Jain) vinod* Judge Whether speaking / reasoned:
