Prayer in present writ petition is for quashing of Tender-cumAuction dated 03.09.2024 issued by respondent No.3 as the same was allegedly conducted in a completely arbitrary manner, ignoring all terms and conditions as well as eligibility criteria mentioned in the Auction Notice and RFP Guidelines, for the sole purpose of preventing participation of Petitioner in the tender process.

Learned counsel for the respondent No.1, submits that petitioner no longer remains disqualified. He has been permitted to participate in the tender process, therefore, this petition is rendered infructuous.

However, learned counsel for the petitioner submits that question of respondent Nos. 4 and 5 being disqualified has not been addressed by the respondents till date.

Learned counsel for the respondent No.1, responds by submitting that objections as raised by petitioner in respect to eligibility of respondent Nos. 4 and 5 shall be decided within one week from today and definitely before the bidding process, by way of speaking order. 5.

In view of above, no further orders are called for in this writ petition, which is disposed of accordingly.
