Petitioner has filed this petition under Article 226 of the Constitution of India seeking a writ in the nature of mandamus directing the official respondents to take appropriate disciplinary action against respondent No. 6.
Notice of motion was issued in this case.
Respondents in their reply have submitted that the matter was duly enquired by the committee and it transpired that the complaint submitted by the petitioner was baseless and founded on conjectures and surmises. Report of the Complaint Committee has been placed on record as Annexure R-1. The concluding para of the said report dated 7.1.2014 reads as under:- "The committee has gone through the statements on record and oral submissions by the complainant as well GURPREET SINGH 2016.02.05 10:16 I attest to the accuracy and authenticity of this document chandigarh
Civil Writ Petition No. 21209 of 2013 -2as witnesses. The committee even visited 51 Bn. to interact with the families residing in the vicinity of the complainant's quarters. After all these prudent efforts the committee could not find any evidence to substantiate 'sexual harassment' as alleged in the complaint and as such, the committee is of the unanimous view that the complaint is baseless and founded on conjectures and surmises. Hence, the committee recommends closing this case."
Since in the present case, the matter has been duly enquired by the Complaint Committee and report has been submitted by the committee, no further interference by this Court is called for.
Petition stands disposed of accordingly.
