In addition to the requisite qualification prescribed for the post of Inspector, Cooperation Department as per new set of Rules, namely, Punjab Cooperative (Group B) Service Rules, 2016 (for short, 'the 2016 Rules'), petitioners have also done their Higher Diploma in Cooperative Management from National Council for Cooperative Training. Their sole grievance in the instant writ petition is that while advertising the posts of Inspectors in terms of the qualification prescribed under the 2016 Rules, there ought to have been a clause to give preference/ weightage to the candidates possessing the above-stated Diploma. We have heard learned counsel for the petitioners at a considerable length.

CWP-17018-2016 -2Since the selection process is at the initial stage and only advertisement has been issued so far, the question of short-listing the candidates based upon a transparent, fair and just criteria is yet to come. We have no reason to doubt that the authorities will act strictly in accordance with law and the additional/higher or preferably qualifications possessed by the candidates, which are relevant with reference to the nature of duties to be performed by the appointees, would surely be given due weightage as may be permissible under the law. Still further, if there is denial of due benefit at the appropriate stage, the petitioners or any other affected candidate would not be remediless.

We, thus, dispose of this writ petition at this stage in the light of above observations with liberty to the petitioners to submit an appropriate representation to the competent authority for grant of weightage for their specialised qualifications as and when the occasion arises.
