(Oral) By this second petition, filed under the provisions of Section 439 of the Cr.P.C., the petitioner seeks the concession of 'regular bail', the first one having been withdrawn by him on 27.03.2019. The petitioner having been in custody for about 11⁄2 years (even taking into consideration the period that he remained on interim bail), with only 05 out of 11 prosecution witnesses having been examined and with no other criminal case shown to be registered against him as per the custody certificate filed in Court today, without making any comment on the actual merit of the case, for or against the petitioner, this petition is allowed.
