IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CWP No. 1800 of 2015 Date of decision: 12.05.2016 Rajinder Pal Singh ....Petitioner(s)

Versus

State of Punjab and another

...Respondent(s)

CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA

Present:

Mr. Anupam Bhardwaj, Advocate, for the petitioner.

G.S.SANDHAWALIA, J. (Oral) The petitioner is claiming promotion to Class-III post on the date his juniors were promoted.

It is not disputed that the petitioner retired on 31.07.2007. Nothing has been brought on record to show that what is his legal right as such, on the basis of which, he is entitled for promotion. The claim is now based on a representation dated 10.10.2014 (Annexure P-3), which has been filed belatedly.

In such circumstances, this Court is of the opinion that it is not a fit case to exercise extra ordinary jurisdiction under Article 226 of the Constitution of India.

Accordingly, the present writ petition is dismissed and the petitioner is relegated to avail his alternative remedy, if any, in accordance with law.
