JASWANT SINGH, J (ORAL) The petitioner, who was working as Assistant Manager with Mahilpur Primary Cooperative Agricultural Development Bank Ltd, Mahilpur, has prayed for issuance of a writ of Certiorari for quashing order dated 10.12.2015 (P.1) passed by respondent No.2-Managing Director whereby his services were removed for being absent from duty since 22.7.2014 without any information, on the basis of charge sheet dated 26.8.2014; with further direction to the respondents to reinstate him with consequential benefits. Meanwhile, an application bearing CM No.5603 of 2017 has been moved by the petitioner seeking permission to withdraw the present petition with liberty to file appeal before the Board of Directors of the respondent-Bank with further prayer to the

CWP No.1703 of 2016 #2# respondents not to raise objection of limitation, in case appeal is filed within one month of receipt of certified copy of the order. He has placed reliance upon the decision passed in CWP No.6307 of 2013, which was disposed of with the aforesaid liberty to the petitioners therein.

Learned counsel for the respondents has not disputed to the said request.

In view of the above, application bearing CM No.5603 of 2017 is allowed and the writ petition bearing CWP No.1703 of 2016 is dismissed as withdrawn. The respondents shall not raise the objection of limitation, in case, any appeal is filed within one month of receipt of certified copy of the order.
