Main case Prayer in the present petition filed under Article 227 r/w Section 151 CPC is for setting aside the order dated 04.04.2022 (Annexure P-12) passed by Civil Judge (Jr. Divn.) Gurugram vide which petitioner was proceeded against ex parte.

At the outset, a pointed query is put to the learned counsel as to how the instant petition is maintainable since the petitioner had been proceeded against ex parte vide order dated 04.04.2022 (Annexure P-12). Learned counsel for the petitioner has very fairly conceded that an application had been filed before the Court concerned for setting aside the order dated 04.04.2022 vide which he had been proceeded against ex parte and which is still pending adjudication before the trial Court.
