The challenge in this writ petition is to the order dated 10.08.2016 (Annexure P-13) whereby the stay application filed by the petitioners was dismissed by respondent No. 2, without considering the basic elementary submission of the petitioners that their statutory objections under Section 13(3-A) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (SARFAESI Act) have not been replied/disposed of by the respondent-Bank. 2.

After arguing for sometime, learned counsel for the petitioners submitted that that he may be allowed to withdraw the present writ petition with liberty to the petitioners to file a review application before the Debts Recovery Tribunal, Chandigarh.

Dismissed as withdrawn. It shall, however, be open to the petitioners to take recourse to the remedies as may be available to them, in accordance with law.
