(Oral) The case of petitioners is that they have been appointed much prior to the persons reflected in order dated 18.07.2017 (Annexure P-4), whose services have been regularized w.e.f. 01.04.2011, whereas, Annexure P-1 reflected regularization in the month of August 2004. No plausible explanation has come forth. The order dated 18.07.2017, (Annexure P-4) reflected regularization on the basis of directions issued by this Court in CWP No.14131 of 2016. The petitioners stated to have submitted a legal notice dated 14.04.2019, (Annexure P-5) in this regard but no action has been taken so far Learned counsel contends that the petitioners, at this stage, would be satisfied if a direction is issued to respondent No.2 to consider and decide legal notice dated 14.04.2019 (Annexure P-5) within some specified time in the light of the order (Annexure P-4). CWP No.18360 of 2019 {2} Without going into merit of case or commenting thereon, I deem it appropriate to dispose of present writ petition with a direction to respondent No.2 to decide the legal notice dated 14.04.2019 (Annexure P-5) considering the case of petitioners at par with the persons reflected in order dated 18.07.2017, Annexure P-4 by passing a speaking order after affording opportunity of hearing to the petitioners within a period of four months from the date of receipt of certified copy of this order. In case the petitioners are found successful, benefit as per the order Annexure P-4 should be given in order to avoid any further litigation. It is made clear that in case the aforementioned legal notice is not decided within the specified time, there shall be costs of ` 50,000/- to be paid by the concerned officer to the petitioners.
